If you have full coverage on your car, you’ll typically report the claim to your insurance carrier immediately. They may tell you to go through your other party’s insurance, and since that will require you to give a statement to the other party’s insurance company, you should usually first speak with a lawyer. Otherwise, you may end up saying something that could be used against you later in a civil case.
By going through the other carrier, you won’t have to pay your deductible, but note that some policies (perhaps yours) waive the deductible if the other driver’s insurance company has accepted liability at the inception of the case. It is also a good idea to use your own full coverage insurance if the other driver has low limits or if there is a lot of harm caused by the carelessness.
As of October 30, 2017, California’s minimum statutory limits for insurance are $15,000 per person for bodily injury, up to a maximum of $30,000 per collision, and $5,000 in property damage. If you have more than $5,000 in property damage and the person who caused the damage has only $5,000 in insurance, you’re better off going through your own insurance company. In that case, your insurance company will pay your harms, pay your losses, pay to replace or repair your vehicle, and then they’ll seek money from the other driver’s insurance company through a process called subrogation.
